Welcome to Talentberry, an AI-based interview platform (also referred as”Application”)developed by Skynetic Ventures LLP (also referred as “the Company”). These Terms andConditions (also referred as “Terms”) govern your access and use of the Talentberryplatform, website, and related services (collectively, the “Services”). By using our Services,you agree to these Terms. If you do not agree, you must not access or use our Services.
ACCEPTANCE OF TERMS:
By accessing Talentberry, you accept these Terms and agree to comply with all applicableinternational and local laws and regulations. If you do not agree with any part of theseTerms, you must stop using our Services immediately. Talentberry reserves the right to update or modify these Terms at any time. Changes become effective upon posting to our website, and your continued use of our Services constitutes acceptance of the revised Terms.
ELIGIBLITY:
You must be at least 18 years of age or the minimum legal age in your jurisdiction to access our Services. By using Talentberry, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
USER ACCOUNTS:
To access certain features, you may be required to register an account. You agree to provide true, accurate, and complete information during and after registration and are responsible for all acts done through the use of your registered account.
You are responsible for safeguarding your account credentials and any activity conducted under your account. Failure to maintain accurate account information may result in your inability to use our services.
We reserve the right to suspend or terminate your account if you provide false information,
violate these Terms, or engage in unauthorized use of our Services.
PERMITTED USE:
You agree to use Talentberry solely for lawful purposes. You may not:
1. Modify, copy, or reverse engineer our platform.
2. Share or transfer access to your account without our consent.
3. Use our Services to engage in illegal, abusive, or disruptive behavior.
4. Upload content that infringes intellectual property or privacy rights.
5. Attempt to disrupt, hack, or overload our systems.
The Company reserves the right to terminate or restrict access for any violation of these Terms.
FREE TRIAL SESSION AND SUBSCRIPTION FEE:
(a) Upon successful registration, you will unlock the benefit of one free session.
(b) You are responsible for ensuring timely payment of the subscription fees.
(c) Failure to make a payment by the due date may result in suspension or termination of access to the Application.
(d) If a payment fails, the Company may attempt to process it again or require an updated payment method. Continued non-payment may lead to account cancellation.
(e) The Company is not responsible for disruptions caused by missed payments.
INTELLECTUAL PROPERTY:
Talentberry and its content, including but not limited to software, designs, and trademarks,are owned by Skynetic Ventures LLP or its licensors. We grant you a limited, non-exclusive,and non-transferable license to use our Services for personal, non-commercial purposes.
Unauthorized use of our intellectual property is strictly prohibited.
You shall not reproduce, distribute, or modify any content without prior written consent.
USER GENERATED CONTENT:
(a) Any content you submit to the Application must not infringe on third-party rights or contain illegal material.
(b) By posting content, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and worldwide license to use, display, reproduce, and distribute the content to operate and improve our Services
You represent that you own or have the right to share any content you upload. We reserve the right to remove any content that violates these Terms or applicable law.
PRIVACY:
Your use of the Application is also governed by our Privacy Policy, which can be found[Insert Link]. By using our Services, you consent to our data practices as described in the Privacy Policy. International users acknowledge that their data may be transferred to and processed in jurisdictions where privacy laws may differ from their home country.
LIMITATION OF LIABILITY:
(a) The Application is provided on an “as is” and “as available” basis without warranties of any kind.
(b) The Company is not liable for any direct, indirect, incidental, consequential, or punitive damages resulting from the use or inability to use the Application.
(c) Nothing in these Terms shall limit liability under applicable laws, including but not limited to consumer protection regulations in various jurisdictions.
To the extent permitted by law, Talentberry and its affiliates are not liable for any indirect,incidental, or consequential damages arising from your use of our Services. Our total liability is limited to the amount you paid for our Services in the 12 months preceding the event
giving rise to the claim.

The Application may contain links to third-party websites. The Company does not endorse or assume responsibility for the content, policies, or practices of any external sites. You access these third-party services at your own risk.
COMPLIANCE WITH LOCAL AND INTERNATIONAL LAWS:
(a) You agree to comply with all applicable laws in your jurisdiction, including but not limited to consumer protection, privacy, and data protection laws.
(b) Users from India must also comply with the Information Technology Act, 2000, and associated regulations. Content that violates laws, including defamation, obscenity, or hate speech, is strictly prohibited.
B2B-SPECIFIC TERMS:
(a) Service Agreements: Businesses using Talentberry must enter into a separate Service Agreement specifying terms such as service scope, pricing, and duration.
(b) Authorized Users: Companies may assign authorized users, for whom they are responsible. Unauthorized sharing of access is prohibited.
(c) Custom Solutions: Custom-tailored solutions for enterprises may involve specific implementation terms outlined in a mutually agreed Service Agreement.
(d) Data Protection: Businesses agree to comply with relevant data protection laws and ensure appropriate handling of employee and candidate data.
(e) Payment and Invoicing: Payment terms for B2B clients will be specified in the Service Agreement. Late payments may incur penalties or service suspension.
(f) Termination for Cause: Either party may terminate a B2B agreement if the other breaches a material term, subject to applicable notice requirements.
REFUND POLICY:
(a) Refunds, if eligible, will be processed through the original payment method.
(b) Refund requests must be submitted within [X] days of subscription with valid proof of transaction.
(c) The Company reserves the right to deny refunds in cases of misuse, policy violations, or fraudulent claims.
(d) Any applicable refund will be processed within [X] business days.
CANCELLATION POLICY:

These Terms are governed by and construed in accordance with the laws of India and applicable international regulations. Disputes will be resolved under the jurisdiction of Bengaluru, India, or the appropriate jurisdiction based on the user’s location.
FORCE MAJEURE:
The Company shall not be responsible for delays or failures in service due to events beyond its control, such as natural disasters, power outages, internet disruptions, government actions, or other unforeseen circumstances.
